1. About these terms
These terms apply when you ask for a free audit or take up a plan with Hive DynamicX, a web studio in Sydney, New South Wales, run by Nathan and Rumman (“we”, “us”). You can reach us at enquiries@hivedynamicx.com.
Before you start a plan, we confirm your scope, price and start date with you in writing (your “proposal”). Your proposal and these terms together make up our agreement. If they differ, your proposal applies.
You sign up by accepting your proposal in writing (a reply by email is fine) and completing checkout.
2. The free audit
- The audit is free and there’s no obligation to buy anything.
- We look at your website, how your business shows up on Google and how enquiries are handled, using public information only. We email you the 2 or 3 fixes we’d make first.
- We send it within 2 business days of your request reaching us. Business days are Monday to Friday, excluding NSW public holidays. If your business isn’t one we can help, we’ll tell you within the same 2 business days instead.
- The audit is general suggestions about your website and enquiries. It isn’t legal, financial, tax or compliance advice, and you decide what, if anything, to change.
3. Plans and what’s included
Our plans are Website, Business and Growth. What each includes is set out on our website when you sign up and in your proposal, including page limits, the number of workflows, monthly edit time and the monthly messaging and AI allowance.
- Monthly edit time and allowances are for that month and don’t carry over.
- If you’d need more than your plan’s messaging and AI allowance, we ask you first. We don’t charge for extra usage you haven’t agreed to.
- New designs, extra locations, advertising and custom integrations aren’t part of a plan. We quote them separately, and you decide before any work starts.
- We work alongside your existing tools, such as booking, point-of-sale or job-management software. We don’t promise a connection to them unless your proposal says so.
4. Prices, GST and paying
- Prices are in Australian dollars and exclude GST. GST is added to each invoice.
- Plans are billed monthly in advance through our payment provider, Stripe, by card or direct debit. You get a tax invoice each month.
- There’s a one-off setup fee of A$399 (ex GST). It’s waived for founding clients who accept their plan in writing by 31 December 2026 (Sydney time), even if the plan starts in 2027.
- If a payment fails, Stripe lets you know and may retry it. If it isn’t sorted out within 14 days of us telling you, we may pause the work in your plan until it is. We won’t take your website offline for non-payment without giving you at least another 14 days’ notice in writing.
5. Cancelling your plan
- Plans are month-to-month, with no lock-in contract.
- You can cancel any time from your billing portal. Your plan runs to the end of the month you’ve already paid for, and you won’t be charged again.
- We don’t refund part months, except where the law requires it (see section 10).
- Before your plan ends, we confirm your end date in writing and make sure you can export your content (see section 7).
6. When we can end a plan
- We can end a plan for any reason by giving you at least 30 days’ notice in writing. If you’ve paid for time after the end date, we refund it.
- We can end a plan sooner, with written notice, if a payment is more than 28 days overdue after we’ve told you about it, or if the service is being used for something unlawful or harmful.
- Whoever ends a plan, we follow the handover steps in section 7.
7. Your content, domain and data
- You own the content you give us (text, photos, logos) and your business records, including the enquiries your website receives.
- You keep control of your domain name. If we register a domain for you, we register it in your name.
- Our reusable templates, code and tools stay ours. While your plan is active you can use everything we build for you. Third-party tools and platforms have their own licences.
- When a plan ends, we give you an export of your content and records in a common format and help move your domain. A site or workflow we host may need rebuilding to run somewhere else; your proposal sets out what the handover includes.
- We don’t delete your data just because a plan ends. After handover we keep it only as long as the law requires or you ask us to. You can ask us to delete it sooner.
- How we handle personal information is in our privacy notice.
8. What we need from you
- Accurate information about your business, and access to the accounts we agree we need.
- Approval of content before it goes live. You’re responsible for the accuracy of your prices, licence details and other claims about your business.
- The right to use anything you give us, such as photos and logos.
- Health practices: please don’t send patient health information through our forms or email. Your practice stays responsible for its advertising under the Ahpra guidelines.
9. What we don’t promise
- We don’t guarantee search rankings, a number of enquiries, sales or revenue. Those depend on many things outside anyone’s control.
- We rely on third-party services such as hosting, email, Google, HighLevel and Stripe. They can change or have outages. When that happens we do what we reasonably can to keep your service running and tell you if it affects you.
10. Your rights and our liability
Nothing in these terms takes away your rights under the Australian Consumer Law or any other law that can’t be excluded. That includes the consumer guarantees that our services will be provided with due care and skill.
Where the law allows, if we fail to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again. Otherwise, and where the law allows, our total liability to you is limited to the fees you paid us in the 3 months before the claim, and we aren’t liable for indirect losses such as lost profits.
11. Changes to prices and these terms
- We’ll give you at least 30 days’ notice by email before we change your plan’s price or these terms in a way that affects you.
- If you don’t want to continue, you can cancel before the change takes effect, at no cost.
12. Questions and disputes
If something isn’t right, email us first and we’ll work with you to sort it out. These terms are governed by the laws of New South Wales, Australia.
